Effective Date: September 1, 2024 Last Updated: January 5, 2026
Oceans Montessori Academy, LLC (“Oceans,” “we,” “our,” or “us”) is committed to maintaining a safe, transparent, and legally compliant operation. These Terms of Use constitute a legally binding agreement between the enrolled Family/Parent/Guardian (“User”) and Oceans Montessori Academy.
This document describes the financial obligations, operational standards, withdrawal requirements, grounds for disenrollment, and intellectual property rights associated with the use of Oceans’ services, facilities, and digital platforms. Enrollment in Oceans’ program or use of its services signifies the User’s unconditional acceptance of these Terms.
1. Scope and Acceptance of Terms
These Terms govern enrollment, financial obligations, operational requirements, and the use of Oceans’ website and services.
2. Intellectual Property and Brand Ownership
All content provided by Oceans, including but not limited to the name Oceans Montessori Academy℠, the Oceans logo, original curriculum materials, photographs, and website text, is the exclusive property of Oceans Montessori Academy, LLC and is protected by United States copyright and common law trademark protections.
- Prohibited Use: Any unauthorized use, reproduction, or distribution of our brand marks (™ or ℠) or materials without express written consent from the Director of Operations is strictly prohibited.
3. Financial and Enrollment Obligations
A. Tuition Funding (N.M. Universal Child Care Program)
Primary tuition and program fees are administered through the New Mexico Universal Child Care (UCC) Program. The User agrees that continued enrollment is contingent upon the child and family maintaining eligibility and compliance with all ECECD requirements.
B. Incidental Fees and Default
The User is responsible for any separate incidental fees (e.g. specialized activities, supplies) not covered by the UCC Program.
- Payment Due: Fees must be paid in full within seven (7) calendar days of the due date.
- Non-Payment/Default: Failure to pay incidental fees by the deadline may result in the disenrollment of the child. Oceans reserves the right to pursue outstanding balances through civil legal action, and the User agrees to be responsible for any associated collection costs and reasonable attorney’s fees.
C. Withdrawal Notice
Families must provide the Program Director with a minimum of two (2) weeks’ written notice for voluntary withdrawal from the program.
4. Conduct and Disenrollment Policy
A. Behavioral Standards and Non-Discrimination
Oceans complies with New Mexico Childcare Regulations, including the promotion of positive guidance and self-discipline, and the prohibition of discrimination based on race, religion, gender, sexual orientation, disability, or any other status protected by state or federal law.
- Prohibited Conduct: Physical punishment, humiliation, withdrawal of food/rest/bathroom access, or abusive language are strictly prohibited.
- Redirection: The primary guidance strategy used is positive redirection.
- Parent/Guardian Conduct: Hostile or aggressive behavior by a User toward staff, children, or other families is prohibited and constitutes grounds for immediate disenrollment.
B. Grounds for Expulsion
Oceans reserves the right to terminate enrollment immediately for failure to pay incidental fees, ongoing aggressive behavior by the child posing a danger to self or others, or parental non-compliance with health, safety, and administrative policies.
5. Health, Safety, and Privacy
A. Sick Child Policy
Users must pick up a sick child immediately upon contact. Children must be symptom-free for a period of twenty-four (24) hours without the aid of fever-reducing or symptom-masking medication before returning to Oceans.
B. Confidentiality of Records
All child and family records are handled with strict confidentiality and will not be publicly released without written consent, except as required by law or for program eligibility audits.
C. Emergency Authorization
Oceans’ staff are authorized to administer First Aid/CPR, call emergency services (911), and authorize transportation to a medical facility if the User cannot be reached.
6. Website Information
While Oceans strives for accuracy, website content is for informational purposes. Oceans is not liable for typographical errors.
7. Limitation of Liability and Assumption of Risk
By enrolling a child at Oceans, the User acknowledges and agrees that participation in all activities involves inherent risks of injury or property damage.
Oceans, its staff, and its affiliates shall not be liable for accidental injury, loss, or damage to property unless such injury, loss, or damage is directly caused by the gross negligence or willful misconduct of Oceans. The User agrees to hold Oceans harmless and indemnify Oceans against any claims arising from ordinary negligence, inherent risks of child-to-child interaction, or incidents that occur without the gross negligence or willful misconduct of Oceans, to the fullest extent permitted by the law.
8. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the State of New Mexico. Any legal action or dispute shall be resolved exclusively in the courts of New Mexico. This document supersedes any previous oral or written representations.
9. Changes and Contact Information
A. Changes to This Terms of Use
We may update this Terms of Use periodically. Updates will be posted on our website with a new “Last Updated” date.
B. Contact and Request Management
All official inquiries, concerns, and legal service of process should be directed to the Director of Operations.
